The Judiciary
The courts have historically found it hard to maintain independence with authoritarians in their ranks. Weimar’s judges struggled to constrain the rise of the Nazis, and were then reluctant to oppose the new regime. American judges are increasingly split along partisan lines. Judges have either actively aligned with far-right agendas or been too passive to resist, allowing bad actors to manipulate the law to centralize control.
